Government Extends Fast Track Special Courts Scheme to Combat Rising Incidents of Rape

In a recent parliamentary session, the Minister of State (Independent Charge) of the Ministry of Law and Justice, Minister of State in the Ministry of Parliamentary Affairs, and Minister of State in the Ministry of Culture, Shri Arjun Ram Meghwal, addressed critical questions concerning the establishment of district rape courts, relief measures for victims, and the alarming rise in rape cases across India.

The Honorable Minister responded to queries posed by Shri Bhagirath Choudhary, shedding light on the government's initiatives and the current state of affairs regarding rape cases.

Establishment of District Rape Courts

Acknowledging the pressing need for swift justice in rape cases, Minister Meghwal highlighted the implementation of the Centrally Sponsored Scheme for setting up Fast Track Special Courts (FTSCs) and exclusive POCSO (e-POCSO) Courts. Since October 2019, these courts have been operational with the aim of expediting trials and disposing of pending cases related to rape and the Prevention of Children from Sexual Offences (POCSO) Act.

The scheme, initially set for one year, has been extended until March 2023 and further prolonged to March 2026, with an outlay of Rs. 1952.23 crores. The significant extension underscores the government's commitment to ensuring timely justice for victims of sexual offenses.

As of December 2023, 757 FTSCs, including 411 exclusive e-POCSO Courts, have been functional across 30 States/Union Territories. These courts have successfully disposed of over 2,14,000 cases, reflecting the efficacy of the fast-track approach in addressing the backlog of cases and delivering justice promptly.

Relief Measures and Compensation for Victims

Minister Meghwal elucidated on the legal framework aimed at providing relief and compensation to victims of sexual offenses. The Criminal Law (Amendment) Act, 2018, mandates specific timelines for investigation, trial, and appeals in rape cases, minimizing trauma and enhancing access to justice.

Furthermore, victims are entitled to free legal services under the Legal Services Authorities Act, 1987. The government, in coordination with state authorities, has formulated schemes for compensating victims and their dependents who have suffered losses due to crimes. The details of compensations awarded from 2017-2018 to 2023-2024 highlight a substantial effort in supporting victims of heinous crimes.

Alarming Trends in Rape Cases

Responding to concerns regarding the escalation of rape incidents from 2010 to 2022, Minister Meghwal referenced data compiled by the National Crime Records Bureau (NCRB). While specific details for 2023 were not available at the time of the session, the NCRB's publications offer insights into the state-wise distribution of registered cases, charge-sheeted cases, convictions, and completed trials during the specified period.

The minister's comprehensive responses underscore the government's multifaceted approach in combating the scourge of rape and ensuring justice for victims. The extension of the FTSC scheme, coupled with efforts to provide legal aid and compensation, reflects a proactive stance in addressing societal challenges.
